Introduction
Since the beginning of the seventies of the previous century which is
considered to be the actual starting of the development and upgrading
the national economy which depends on export and import . The marine
trade plays the greatest role with in the total international trade ,
therefore the responsible authorities have recognized the role played by
the chamber of shipping so the law No. 52 of the year 1973 has been
legislated for the establishment of chambers of shipping and two
shipping chambers were established by the ministerial degree No. 165 of
the year 1973 , one in Tripoli and the other in Benghazi .
Due to the amalgamation of the private sector with the public sector ,
the role of chambers was insignificant up to the end of the eighties
where the activity of the two chambers has recommenced by the resolution
of the secretary of maritime transportation No. " 429" 1987.
At the beginning of nineties , due to the satisfaction of the
authorities by the necessity of coordination between the existence of
private sector together with the public sector to match the new changes
on the global space and to develop the economical infrastructure , some
special bodies were permitted to exercise marine activities in a legal
form , therefore the previous situation has been reviewed and the former
law was amended and replaced by the law No. (18) of the year 1991 and
generated the idea of establishing one shipping chamber all over
Jamahiriya " the existing one " which has been established as per the
resolution of the general peoples committee No. 154 for the year 1992
based on the abovementioned law but Benghazi chamber has been allowed as
an office to carry out its role as in the previous situation .
Objectives :
The shipping chamber targets to protect and guard the maritime affaires
and services which will be provided to ships , good , passengers and to
report the necessary proposals to upgrade , develop and improve them .
The chamber protects the interests of its members related to its
purposes and defend , represent them before all authorities .
The chamber plays an effective role in developing the marine
transportation industry and seaports and in spreading knowledge about
maritime shipping affairs through the following : -
* Conducting shipping conferences , symposiums and seminars .
* Preparation of marine and shipping studies and researches with the
intent to add new values for upgrading the compliancy of the tools of
exercising the maritime , shipping economical activity .
* Gathering , classification of shipping data and to provide them in
statistical forms and guiding , manuals so as to promote the activity of
its members .
* Cooperation with other authorities and regional , international
organization and to open effective communication means for serving the
maritime shipping in Libya .
Tariff of agents rights :
* Table of tariff of agents rights in respect of accounting revenues between the maritime shipping agents and the owners , chartered party and the suppliers of vessels.
First item :
The shipping agent shall be entitled to receive from the owner or charter of the vessel or any one on his behalf against the protection of the vessel's interests for each tour to the seaport , the following revenues and fees : -
- Vessels with the load of up to two thousand tons
"GRT" 500 L.D - Vessels with the load from two thousand and one ton and above
" GRT" 700 L.D - Oil and oil products carrier with the load up to thirty thousand
MT
" DWT" 1200 L.D - Oil and oil products carrier with the load from thirty thousand
and one up to one hundred thousand
MT " DWT " 1800 L.D - Oil and oil products carrier with the load from one hundred thousands and one and above " DWT" 2400 L.D
The second item :
The shipping agent is entitled to the following from the ship owner or chartered party : -
- Of the value of marine transportation rental for the exported
products and not locally manufactured and reserved through the agent
10 %
- Of the value of marine transportation rental for the locally
produced products to be exported and the exclusion of oil carries .
3 % .
- Of the value marine transportation rental value of exported
goods not locally manufactured and reserved with the knowledge of
the ship owner or the one on his behalf . 3 %
- Of the value of marine transportation rental for goods supplied
from Mediterranean sea ports . 4%
- Of the value of marine transportation rental for goods supplied
from ports out side the Mediterranean sea . 3 %.
- Of the value of passengers tickets reserved by the agent : 10 %
- Of the value of delay fine of containers , trucks and other equipments 5 %
- Of the value of marine transportation rental locally collected through the agent 5 %
- Of the value of ships delay fine " locally " and deducted from the ship owner or chartered party by the agent : - 5 %
- Of the value of amounts paid by this shipping agent on behalf of the sip owner or its agent in the event that his account is indebted to the shipping agent or his representative . 10 %
Third item :
The shipping agent is entitled to receive from the ship owner or his representative the following fees against the performance of limitation , accounting and sounting and the supervision of the discharged or loaded products : -
- Good shipped on traditional ships for each ton for ambulant good
such as crops and fodders = 600 dirham .
- General goods and goods shipped on rolling ships for each ton or
m3 which is larger : 400 dirham.
- Filled crops or filled products for each ton = 200 dirhams .
The oil carriers are exempted from the above item .
Fourth item :
The shipping agent is entitled against the supervision of containers , trucks and equipments and opening records , the follow-up , storage and handle it at the shipping agent area until reshipped , to the following fees :
- Container or truck 20 feet per day with minimum limit 60 L.D 2 L.D
- Containers or truck 40 feet per day and with minimum limit 120 L.D 4 L.D
Fifth item :
- Against general administration services relating to the
shipment documents :
200 L.D - Receipt and clearance of airway bills regarding the documents for each airway bill : 30 L.D
- Against the stamp duty and mail stamp 40 L.
- Against the mail wire " the actual value plus : 10 % .
- Against the wires and wire equipments of the shipping agent for each minute with minimum limit 20 L.D 2 L.D
- Against the use of transportation means such as the vehicle at the commercial ports per day from the date of the arrival of the ship at the port basin with minimum limit 600 L.D for each tour 30 L.D
- Against the use of the means of transportation at the oil ports per day from the date of arrival of the ship to the territories of the port and with minimum limit 600 L.D - 40 L.D
- Additional fees for each day against each oil carrier after two days from its birthing . 100 L.D
- The costs of using the shipping agent boat inside the basin for each tour 30 L.D
- Against using the shipping agent's boat outside the basin for each tour 100 L.D
- Medical tests for each individual without the medicines
costs 10 L.D
- Transportation and bringing the crew for each individual with save the traveling and residence costs : 25 L.D
- The services of customs procedures for each journey : 25 L.D
- Against any claim upon reservation or damage during the follow-up of shipping claims procedures : 100 L.D
- Marine objection procedures submitted by the shipmaster in addition to the actual fees 10 L.D
- Procedures or re-delivery of the ship to its owners in addition to the actual fees .
- catering and medicines cost plus the actual value : 10 L.D
- Banking services and any other expenses or services plus the actual value . 40 L.D
- protection agent costs for each single tour in one port : 600 L.D
- The shipping agent shall be entitled to be paid in the event of re-shipment of the arrived goods to the Libyan ports as per the prices of the last of the original shipment plus the other expenses .
- The use of discharge equipments the actual value .
- Cleaning of quay the actual value
- The fees of loading and discharge : the actual value .
- Cleaning of vessel the actual value .
- The vessel levies the actual value .
Sixth item :
- The sipping agent shall receive from the importer against the notice of arrival of goods 5 L.D
- The shipping agent shall receive from the importer against each
delivery permission issued by him 10 L.D
