The law No. 18 of the year 1991 in respect of the establishment of the shipping chamber :
General peoples congress :
Pursuant to the decisions of the basic popular congresses in its
ordinary second meeting for the year 1990 which have been issued by the
general forum for the popular congresses , peoples committee , trade
unions , federations and vocational associations in its ordinary
sessions from 11-17/6/1991 .
And after the perusal of the law No. 52 of the year 1973 in respect of
the establishment of the shipping chamber .
The following laws has been articulated : -
Article 1 :
Shipping chambers shall be established enjoying corporate body and the
location of each of them and its jurisdiction shall be determined by a
resolution issued by the general peoples committee according to the
presentation of the general peoples committee for transportation and
communications and subject to its control as per the provisions of this
law .
Article 2 :
The shipping chamber objectives includes the protection of shipping
affairs and services provided or the ships and goods and passengers and
to submit any necessary proposal for up grading its competence and
improvement and shall also protect the interest of its members related
to its purposes and represent them before any authorities .
These chambers shall also help in the settlement of conflicts resulting
between the members and with others and shall also settle these
conflicts through arbitration based on the agreement of the concerned
parties .
Article 3 :
The persons or legal person shall not be permitted to exercise the
shipping works and shipping agencies services unless registered as a
member with the chamber where the licensed work is located with in its
jurisdiction.
The licensed parties must settle their registration positions during one
month from the date of effective of this law and under all cases the
registration shall be made a decision from the chamber administration
committee upon a request submitted thereto enclosed with a copy of the
activity exercise license and the administration committee may accept as
a member any one exercising work related to the shipping or maritime
agencies .
The chamber general secretary shall register any accepted member on a
record prepared for this purpose after the member payment of the
determined fees .
Article 4:
Each member shall pay to the chamber with in the first month of each
year the determined annual contribution .
Article 5 :
The annual fees and contributions shall be determined by a decision from
the general peoples committee for transportations provided that the
registration fees must not exceed five hundred L.D and the value of
annual contribution shall not exceed thousand dinars .
Article 6 :
The chamber administration committee may determine the cancellation of
the member name who shall not pay the annual contribution fees and may
be re-registered if he paid the contribution . The general peoples
committee based on the proposal of the general peoples committee for
transportations may determine the situations where the chamber mall
terminate the membership of any party and the object procedures against
this decision and the conditions required for the re-registration .
Article 7 :
The license of exercising shipping and shipping agencies works shall not
be renewed before the submission evidence of payment of contribution
fees to the chamber .
Article 8 :
The chamber management shall be undertaken by an administrative
committee composed of five members , three of them shall be selected by
the general assembly from its members and the representative of the
concerned department at the general peoples committee for transportation
and the representative of the customs department , the appointment of
the administrative committee secretary and members shall be made by a
decision from the general peoples committee for transportations .
Article 9 :
The period of the administrative committee membership shall be four
years and may be renewed for the same period .
Article 10 :
The administration committee shall meet upon the invitation of its
secretary once each month and the meeting shall not be deemed correct
unless attended by the majority of members including the administration
committee secretary or his representative and the decision shall be
taken by the majority members .
Article 11 :
The administration committee may take any decisions which may deem
necessary for achieving its purposes and management of its affairs and
particularly may decide the following :-
* The appointing of the general secretary of the chamber within its
members .
* To set out the necessary estimated budget for running its activity .
* The appointment of the alternative of the secretary of the
administrative committee during his absence or upon the existence of any
reason for his absence .
Article 12 :
A decision from the peoples committee based on a proposal submitted from
the general peoples committee shall be issued for the approval of
internal , administrative and financial regulations of chambers .
Article 13 :
The decision of the administrative committee shall be reported to the
secretary of the general peoples committee for transportation during 10
days from the date of its issuance and these decision shall not be valid
except with the approval of or the expiry of two weeks from the date of
its transfer .
Article 14 :
The secretary of the administrative committee shall preside the meetings
of the administrative committee and control the chamber works and
follow-up its activities and represent it with the others and before the
judiciary .
Article 15 :
The chamber general secretary under the supervision of the secretary of
the administrative committee shall run the administrative , and
financial affairs of the chamber with the assistance of a sufficient
number of employees .
Article 16 :
The general assembly of the chamber is composed of all its registered
members who paid the annual contributions .
Article 17 :
The general assembly of the chamber shall meet once each for year under
the presidency of the secretary of the general peoples committee of
transportation or his representative by an invitation from the secretary
of the chamber administrative committee for the negotiation of the
annual report submitted by the administrative committee about the
chamber activity and the approval of the final account and issue its
instructions and observation about the chamber's works .
Article 18 :
The financial resources of the chamber are composed of the following : -
* Registration and contribution fees
* The amounts against the provision of services for others .
* The amounts collected from the treasury .
* Donations and grands .
Article 19 :
The concerned public control authorities shall audit the shipping
chamber accounts .
Article 20 :
The law No. 52 for the year 1973 shall be deemed cancelled and any
provision contrary to this law shall be invalid .
Article 21 :
This law shall take effect from the date of its issuance and published
on the official gazette and other different mass media .
